Hon. Richard Wagner, P.C., Chief Justice of Canada<\/a> made the rare decision on Thursday that the decision is of sufficient national concern that the government can use the POGG clause \u2014 a decision that six judges were entirely in favour of, with one partial dissent and two entirely in disagreement with the majority.<\/li><li><\/li><li>Further, it recognized that \u201cclimate change is real\u2026 and it poses a grave threat to humanity\u2019s future\u201d and recognized that matters are of national concern when there are grave extraprovincial consequences.&nbsp;<\/li><li><\/li><li>The SCC noted that the impacts of climate change will be borne disproportionately by vulnerable communities and regions in Canada, which justify the limited constitutional impact on provincial jurisdiction.&nbsp;<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-image size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/allanhardingmackay.ca\/courtpainter\/wp-content\/uploads\/2021\/03\/unhappy-premiers-copy.jpg\" alt=\"\" class=\"wp-image-15633\" width=\"1000\" height=\"563\" srcset=\"https:\/\/allanhardingmackay.ca\/courtpainter\/wp-content\/uploads\/2021\/03\/unhappy-premiers-copy.jpg 1000w, https:\/\/allanhardingmackay.ca\/courtpainter\/wp-content\/uploads\/2021\/03\/unhappy-premiers-copy-300x169.jpg 300w, https:\/\/allanhardingmackay.ca\/courtpainter\/wp-content\/uploads\/2021\/03\/unhappy-premiers-copy-768x432.jpg 768w\" sizes=\"auto, (max-width: 709px) 85vw, (max-width: 909px) 67vw, (max-width: 1362px) 62vw, 840px\" \/><figcaption>Six provinces were opponents of the federal carbon price law!<\/figcaption><\/figure>\n","protected":false},"excerpt":{"rendered":"<p>Today, Canada\u2019s Supreme Court in a split decision 6-3 , ruled that the&nbsp;Greenhouse Gas Pollution Pricing Act&nbsp;is&nbsp;constitutional.
